Introduction to Marriage Visas – Consular Processing

A U.S. Citizen or Lawful Permanent Resident may petition for a foreign national spouse to immigrate to the United States. If your spouse is currently present in the United States after entering with a visa, then please go to our adjustment of status page.

Eligibility Requirements for a Marriage Visa

You are eligible to petition for your spouse if:

  • You are a U.S. Citizen or Lawful Permanent Resident;
  • You are legally married;
  • Your marriage is real (bona fide);

Your spouse might not be eligible to immigrate if:

  • Your spouse stayed 6 months longer than allowed in the US and then departed, or has been ordered removed from the US;
  • Your spouse has been arrested, charged, or convicted of a crime;
  • Your spouse is “inadmissible” for any reason under Immigration Law.  **The above are common examples, but if you are concerned with your spouse’s prior immigration history, criminal history, membership in a group or any other concerning factor, then please let us know;
  • *As the petitioner, you must show sufficient income by establishing that you: (1) have an adjusted gross income (AGI) of at least 125% of the federal poverty guidelines; (2) have assets that are at least 3 times 125% of the federal poverty guidelines; or (3) have a joint sponsor who has an AGI of at least 125% of the federal poverty guidelines;
  • *Waivers/Pardons: U.S. Immigration Officials will grant pardons (waivers) in some situations.

Filing Fees and Costs

  • USCIS Fees – Form I-130 Petition – $535;
  • National Visa Center Fees: Visa Issuance Fee – $325,  Affidavit of Support Fee – $120;
  • USCIS Lawful Permanent Resident Card Issuance Fee – $220;
  • Medical Examination – Costs vary depending on location.
